Fresh Hurdle: 3 Appeals Delay Bulldozer Action In Kachipura The planned demolition of illegal commercial structures in Kachipura has faced a new delay as three additional occupants have filed appeals seeking a stay on the proposed action. Despite the Maharashtra state government clearing the way for the demolition, the Nagpur Municipal Corporation (NMC) has paused proceedings to verify whether pending legal challenges could derail the operation. Officials confirmed that the civic body’s legal and town planning departments must first assess the status of these appeals before invoking Section 53(1) of the Maharashtra Regional and Town Planning (MRTP) Act. The appeals pertain to land under Khasra Nos. 204 to 209, owned by Dr Panjabrao Deshmukh Krishi Vidyapeeth (PDKV). NMC Dharampeth Zone Assistant Commissioner Rajkumar Meshram informed the legal and town planning departments via letters dated July 3 and July 13, highlighting that while earlier appeals under Section 47 of the MRTP Act had been dismissed by the state government, three new occupants have now moved the government to block the demolition. This development comes after the state government recently upheld the NMC’s stance, vacating a 2016 stay order that had stalled the eviction drive for nearly a decade. The proposed demolition targets illegal constructions spanning 8,051.44 square meters, where 54 entities operate automobile workshops, garages, eateries, timber and wooden workshops, marriage lawns, and other commercial establishments. These structures are built on land occupied by 27 individuals. Despite the state government’s favorable order, the NMC is proceeding cautiously to avoid further litigation that could prolong the eviction process.
