The dispute originated in May 2014, when Kumar Vishwas, then a candidate for the AAP in the Amethi Lok Sabha constituency, was contesting against Congress leader Rahul Gandhi. According to the court records, the then Amethi police superintendent, Mohammad Hamid, issued orders directing Vishwas and his supporters to vacate the constituency, citing the electoral code’s restriction on outsiders staying in the voting area 48 hours before polls. The directive was based on the Election Commission’s rules, which prohibit non-residents from residing in the constituency during the final days of the election. The case escalated after clashes erupted between the AAP leaders and the police. The court documents state that despite the police orders, Vishwas, Jain, and Bharti, along with their supporters, refused to leave the area. This led to the filing of a complaint under the Code of Conduct, accusing them of violating electoral norms. The court has now mandated personal appearances from all three accused, emphasizing the necessity of their presence for the upcoming hearing.
